Lease for Foreigners




Important: The most important thing to consider when preparing a lease for foreigners; The lease contract prepared in accordance with the procedure will have to be notarized before it is delivered to the Immigration Administration. If the foreigner is a Supporting Turkish Citizen who will cover the food, beverage and accommodation expenses during his stay in Turkey, a rental contract is not required. In applications made with the sponsor, a notarized letter of undertaking and income documents of Turkish citizens will be requested instead of a notarized lease contract.


In order to protect the rights of the landlord and tenants, to defend the rights of both parties in case of any problems in the future, and to complete the procedure in accordance with the legal rules, a lease agreement must be signed. It is important for both parties to pay attention to some points while preparing a lease. In the rental contract, the special conditions that are the basis of the agreement between the landlord and the tenant are determined.


With the rental agreement determined by establishing a legal basis, it is made official that the landlord leaves his house for the use of the tenant and that the tenant uses it by paying the rent. While preparing the lease contract, it is necessary to act within the framework of the legally determined laws. The lease agreement has some procedures and standards. The items and fixtures in the house left to the tenant should be written in the rental agreement.


What Should Be Included in the Lease Contract


While preparing the lease contract, matters such as the type of property to be rented and the address information should be included in the contract completely. The personal information of the landlord and tenant must be written correctly in the rental agreement. Items that should be included in the lease contract are:


- Apartment number of the rented house,

- The street and avenue where the house is located,

- The neighborhood where the house is located,

- The type of property rented,

- Personal information such as the name and surname of the tenant and property owner,

- The date of the rental agreement,

- The rent to be paid by the tenant to the landlord,

- How the rent will be paid

- The fixtures in the flat and how they will be used should be clearly stated.


Conditions Required in the Lease Contract


With the lease agreement, the rights of both the landlord and the tenant are protected. Some of the conditions that should be included in the lease are:


The tenant should use the apartment he rented carefully without damaging it.

The lessor cannot rent the flat to a third party.

The tenant cannot make changes to the house without the permission of the landlord.

In cases such as the evacuation of the house, the house must be evacuated within the specified time.

When changes are made regarding the fixtures in the house, the landlord must be informed of this situation.
